Terms of Service

The rules of the road for using The 6 Pass.

1. About these terms

These Terms of Service ("Terms") govern your use of the6pass.ca and the services offered by The 6 Pass Inc. ("we," "us," "our"), a company incorporated in Ontario, Canada. By using the website or joining the waitlist or, in future, purchasing a membership, you agree to these Terms.

2. Who can use the service

You must be at least 18 years old and resident in Canada to join the waitlist or a membership. The service is currently targeted at the Greater Toronto Area.

3. What the service is

The 6 Pass is a curated membership that offers benefits and experiences at partner restaurants, hotels, spas, and other venues. Members pay an annual fee to access member-only offers; participating merchants publish those offers and honour them at the point of service.

4. What the service is not

• We are not a restaurant, hotel, or spa. We do not provide the underlying goods or services — our partner merchants do.
• Availability of offers, reservations, and redemptions depends on the merchant. We do not guarantee any specific table, room, or appointment.
• We are not a coupon company and we don't issue "deals." Our offers are curated benefits with defined mechanics and tier-based access.

5. Memberships (when live)

When paid memberships launch, the following will apply:

• Annual terms: Memberships are sold on an annual basis with the pricing posted on our Pricing page at time of purchase.
• Auto-renewal: Memberships auto-renew at the then-current price. We notify you at least 14 days before renewal. You can cancel renewal at any time from your account.
• Cooling-off: You may cancel within 14 days of purchase for a full refund, provided you have not redeemed any offers.
• After 14 days: Membership fees are non-refundable, except where required by Ontario consumer protection law.
• Offers are subject to change: Partner merchants, offers, and mechanics may change during your membership. We commit to maintaining a high-quality catalogue, but no specific merchant or offer is guaranteed for the full term.

6. Your account

You are responsible for keeping your login credentials secure. You may not share your membership with others. Each membership is for a single individual; a Black tier membership may extend privileges to one named +1 as specified on the pricing page.

7. Rules of use

When you use The 6 Pass, you agree not to:

• Misrepresent yourself to a merchant or use your membership fraudulently.
• Resell, transfer, or share member codes.
• Exceed posted redemption caps.
• Use the service for commercial resale or bulk booking.
• Harass staff at partner venues. Merchants retain the right to refuse service for conduct reasons.

Violations may result in membership suspension or termination without refund.

8. Redemptions

To redeem an offer, you must present your membership in-app and, where required, book in advance through the merchant's booking system. You are responsible for paying any portion of the bill not covered by the offer (taxes, gratuity, items not included in the offer mechanics). Gratuity on the full pre-discount amount is always encouraged and, for fixed offers like prix fixe or bundles, the expected behaviour.

9. Intellectual property

The 6 Pass name, logo, website, and content are owned by The 6 Pass Inc. You may not copy, modify, or use them commercially without permission. Merchant names and logos displayed on the platform are property of their respective owners and used with permission.

10. Limitation of liability

To the fullest extent permitted by Ontario law, The 6 Pass is not liable for:

• The quality or availability of goods or services provided by partner merchants.
• Any loss or damage arising from your experience at a partner venue.
• Indirect, incidental, or consequential damages.

Our aggregate liability to you for anything arising from the service will not exceed the amount you paid us in the previous 12 months.

Nothing in these Terms limits any rights you have under Ontario's Consumer Protection Act or other mandatory laws.

11. Termination

You may cancel your membership's auto-renewal at any time. We may suspend or terminate your membership if you materially breach these Terms, or if we stop operating the service, with a pro-rated refund for the unused remainder of your annual term.

12. Changes

We may update these Terms. Material changes will be posted here with at least 30 days' notice. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable therein. Disputes are subject to the exclusive jurisdiction of the courts of Ontario.
